WHY IS MEDICAL MARIJUANA NOT LEGAL IN ALL FIFTY STATES.
There are two issues at play when attempting to analyze and answer the above question. The first issue has to do with states' rights which triggers a 10th Amendment analysis. The second issue has to do with the legal and political process involved with legalizing marijuana for medical reasons.
The Tenth Amendment.
The Tenth Amendment states the Constitution's principle of federalism by providing that powers not granted to the federal government nor prohibited by the States by the Constitution are reserved to the States or the people. As it pertains to medial marijuana, as of the end of 2010, 15 states have passed legislation which permit the use of medical marijuana. California Proposition 19 tried to make it legal for anyone over age 21, but it did not pass.
The Obama administration announced in lat 2009 that it advised federal prosecutors not to target medicinal marijuana users in states that have passed such laws, but the Drug Enforcement Agency and Department Of Justice continue to raid medical facilities and have prevented publicity of this fact.
