The Law Commission’s Report on the Public Services Ombudsman: A Critique

The non-biased mediator and conflict-solver in between two parties who handles complaints between them, tries to find out the actual reason of the complaint and evaluates  whether the handling of the same is as per the rules in vogue is called an ‘Ombudsman’. ‘Ombudsman” does not have any gender differences and the word becomes “Ombudsmen” when expressed in the plural. The answer to this is that conflicts and misunderstanding between people will always remain and if every such misunderstanding is dragged to a court of law, total chaos will prevail in society. Hence, we have the need for the ombudsman. In the first step, most conflicts are born out of egotism between people and as the ombudsman belongs to the same social strata as the opponents, it is not a difficult task for him or her to provide a viable solution to the problem. This also helps the conflicting parties to accept the verdict of the ombudsman more realistically than that of a session’s court or a tribunal.

The ombudsman can put down a verdict but it cannot see to the implementation of the same as per law. Still the ombudsman enjoys the respect of all concerned parties and most often can play a satisfactory role in resolving the problem, thereby preventing the parties from approaching the law and spend time an
