In the food industry managers need to take special action to protect the tangible property rights since there can be many. Some of them can be the equipment necessary to prepare meals such as oven, microwaves, the refrigerators used to keep the food at the right temperature, the equipment necessary to serve the food and deliver it. “The equipment covered as tangible property are any appliances that cook, mix, chop, brew, or blend the raw materials.  Tangible quality control devices are those such as scales, thermometer, and timers, (Team C discussion).”   Not only the equipment used to prepared the food is considered a tangible property but also the products used to ensure quality control products and that make sure consumers have the highest quality products available in the market.

 

Managers can protect the tangible products rights by having inventory lists of all the equipment used, monitoring those lists on a regular basis. Another alternative is having an employee monitor this equipment, make sure is running smoothly, give the necessary tune up to make sure they are in good working conditions. Lastly for any special machinery have specialized personnel to operate it to avoid any future problems.

“The intellectual properties of food production consist of the knowledge and technology of the chemical or physical changes to the food items to make them marketable.  This includes secret recipes, formulas, certain composition of ingredients that change the raw ingredients to make the finished food product, (Team C discussion).” Some of the actions managers can do to protect the intellectual property rights is encourage the employees to remain loyal, advice and let them know of any sanctions if they divulge private information. Having trademarks registered with the US Patent and Trademark Office will not prevent other organizations from making the same meal for example but will help your organization gain intellectual rights and be recognized by consumers, for example McDonalds and their fries or Chili’s and their Molten cake. Make sure that patents and trademarks are up to date, and that company has all the required registrations. Keeping an eye on the competition or people that can be sent to find out recipes, special ingredients, special preparation techniques, etc. In the case the organization finds out there is another organization using their trademark they can sue on the concept of infringement. Also copyright needs to be protected under the Copyright Designs and Patents Act. This act will protect books of recipe, TV commercials, etc.
