Incident reports are information about an accident or medical error that could result in a law suit. Incident reports are filed with the facility’s risk management office are a secondary source of patient information. The reason for not filing incident reports in patients medical records are because they are considered secondary sources and are not subject to release when patient records are requested. Incident reports are available to the health care facilities attorneys so that if they get sued they will be able to properly prepare a defense. Three examples of secondary sources are if a patient or visitor slips and falls on the floor, if a patient is given the wrong medicine, or if a patient happens to fall out of the bed. All three of these could lead to a lawsuit that is why secondary sources are filed with the risk management not in the patients chart.
