Case Study 1

Since Charlie was starting college in September, he purchased a new e-reader so he could take his textbooks anywhere.  Charlie was very organized and often read his assigned chapters during his lunch break at work.   Charlie purchased the e-reader from the largest electronics store in town for $200 and it came with a 30-day warranty.

Charlie packed for college the day after he bought the new e-reader.  He was taking the old e-reader he used in his freshman year back to campus to sell to one of the new students.  Charlie did not open the new e-reader because he wanted to do so when he was settled in his dormitory. Unfortunately, Charlie forgot to pack the new e-reader; however, he decided that he could use the old one until his father shipped the new one.  The e-reader arrived in the mail a month later and when Charlie finally opened his e-reader, it didn’t work. Charlie contacted the store where he purchased the e-reader. The manager said that there was nothing they could do. What rights does Charlie have?

 

Case Study 2

Since Martha lived in Montana, she was addicted to her morning cup of hot chocolate.   While she loved the smell of coffee, she couldn’t stand the bitter taste.  Martha always picked up a cinnamon marshmallow cup of hot chocolate from the coffee shop on her way to the office.  This morning, the line at the coffee shop was too long; therefore, Martha decided to get a cup from the vending machine at work. The hot chocolate was so hot that Martha dropped it all over herself and was badly burned. Martha filed suit against the vending company, the manufacturer of the vending machine, the owner of the building and the distributor of the hot chocolate.  What rights does Martha have? Explain Martha’s case against each party and possible defenses by each defendant. 

 

Case Study 3

Morrison Modular Shelving (Modular) sells a variety of shelving units for business and home use.  The shelving units require some assembly.  Modular provides simple instructions with illustrations and arranges the hardware, such as screws, nuts, and other items, in specially designed plastic pouches that were sealed to a rectangular piece of cardboard. The number of pouches per item varied from four to eight, depending on the size of the shelving unit.

Modular made an oral contract with Premium Plastic Packaging, Inc. (Premium) under which Premium would supply the plastic packing pouches for the modular shelving units.  Premium made a substantial number of packing pouches following Modular’s specifications. Sales of shelving dropped and Modular refused to take delivery of any pouches. Premium sued Modular for breach of contract.

Will Premium succeed in its breach of contract suit against Modular? Explain why or why not.
