This discussion question requires you to read the scenario and determine how the potential outcome of a lawsuit resulting from the death of someone that inhaled helium gas, despite the warning label.

The Political Action Committee for Better Government (Committee) rented several helium tanks (Tanks) from Vendors Supply, Inc. (Vendors).  The tanks were to fill balloons that the Committee was going to hand out at the Bliss County Fair as part of the Committee’s ongoing efforts to promote the virtues of its programs.  Although the rental contract required the Committee to return the used tanks when finished, the tanks were left at the fairgrounds leaning up against the Committee’s booth.

Arnie Activist, aged 14, attended a concert at the fairgrounds with some friends, where he and his friends discovered the tanks.  Despite the warnings printed on the Tanks, which stated:

CAUTION - HELIUM GAS - CAN CAUSE SUFFOCATION IF INHALED

Arnie inhaled gas from one of the tanks, collapsed, and died. Arnie’s father sued Vendors.
